利用規約

第1条（本規約の適用）

本利用規約（以下「本規約」といいます）は、MyStamp（以下「本アプリ」といいます）の利用に関する条件を定めるものです。 本アプリを利用するすべてのユーザー（以下「ユーザー」といいます）は、本規約に同意の上、本アプリを利用するものとします。

Article 1 (Application of Terms)

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for using MyStamp (hereinafter referred to as "the App"). All users (hereinafter referred to as "Users") shall use the App upon agreeing to these Terms.

第2条（本規約への同意）

ユーザーは、本アプリを初めて利用する際に本規約へ同意することにより、本アプリを利用することができます。 Appleアカウントを利用してサインインした時点で、本規約に同意したものとみなされます。

Article 2 (Agreement to Terms)

Users may use the App by agreeing to these Terms when using the App for the first time. By signing in with an Apple account, Users are deemed to have agreed to these Terms.

第3条（ユーザーコンテンツ）

1. ユーザーは、本アプリにアップロードする画像データ（以下「アップロード画像」）について、自身が著作権を含む正当な権利を有しており、第三者の著作権、商標権、肖像権、プライバシー権、その他一切の権利を侵害しないことを表明し、保証します。
2. アップロード画像を元に本アプリで生成されたスタンプ（以下「生成スタンプ」）の著作権は、生成したユーザー本人に帰属します。
3. ユーザーは、生成スタンプの公開設定を「公開」にした場合、当社に対し、当該生成スタンプを本アプリのサービス内（「みんなのスタンプ」コーナー等）で、他のユーザーへの紹介等を目的として、無償かつ非独占的に使用（複製、表示、公衆送信、頒布等）する権利を許諾するものとします。この許諾は、ユーザーが当該スタンプを非公開とするまで有効とします。
4. 当社は、アップロード画像および生成スタンプの内容を監視する義務を負いませんが、本規約に違反し、またはそのおそれがあると判断した場合は、ユーザーに通知することなく、当該データを削除または非公開にできるものとします。

Article 3 (User Content)

1. Users represent and warrant that they have legitimate rights, including copyright, to image data uploaded to the App (hereinafter "Uploaded Images") and that such images do not infringe upon any third party's copyright, trademark rights, portrait rights, privacy rights, or any other rights.
2. The copyright of stamps generated in the App based on Uploaded Images (hereinafter "Generated Stamps") belongs to the User who generated them.
3. When Users set Generated Stamps to "public," they grant the Company a non-exclusive, royalty-free license to use (including reproduction, display, public transmission, and distribution) such Generated Stamps within the App's services (such as the "Everyone's Stamps" section) for the purpose of introducing them to other Users. This license remains valid until the User sets the stamp to private.
4. While the Company has no obligation to monitor the content of Uploaded Images and Generated Stamps, it may delete or make private any data without notice to the User if it determines that such data violates or may violate these Terms.

第4条（禁止事項）

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

• 法令または公序良俗に違反する行為
• 犯罪行為に関連する行為
• 第三者の著作権、商標権、肖像権、プライバシー、その他の権利を侵害する画像（例：アニメ、漫画、有名人の写真など）をアップロードし、スタンプを生成する行為
• わいせつ、児童ポルノ、暴力的、差別的、その他公序良俗に反するコンテンツを生成、または公開する行為
• 当社のサーバーまたはネットワークの機能を破壊したり、妨害したりする行為
• 当社のサービスの運営を妨害するおそれのある行為
• 他のユーザーに関する個人情報等を収集または蓄積する行為
• 不正アクセスをし、またはこれを試みる行為
• 他のユーザーに成りすます行為
• 当社のサービスに関連して、反社会的勢力に対して直接または間接に利益を供与する行為
• その他、当社が不適切と判断する行為

Article 4 (Prohibited Acts)

Users shall not engage in the following acts when using the App:

• Acts that violate laws or public order and morals
• Acts related to criminal activity
• Uploading images that infringe on third party's copyright, trademark rights, portrait rights, privacy, or other rights (e.g., anime, manga, celebrity photos) and generating stamps from them
• Creating or publishing content that is obscene, child pornographic, violent, discriminatory, or otherwise contrary to public order and morals
• Acts that destroy or interfere with the Company's servers or network functions
• Acts that may interfere with the operation of the Company's services
• Collecting or accumulating personal information about other Users
• Unauthorized access or attempts thereof
• Impersonating other Users
• Providing benefits directly or indirectly to antisocial forces in connection with the Company's services
• Other acts that the Company deems inappropriate

第5条（本アプリの提供の停止等）

当社は、以下のいずれかの事由があると判断した場合、ユーザーに事前に通知することなく 本アプリの全部または一部の提供を停止または中断することができるものとします。

• 本アプリにかかるコンピュータシステムの保守点検または更新を行う場合
• 地震、落雷、火災、停電または天災などの不可抗力により、本アプリの提供が困難となった場合
• コンピュータまたは通信回線等が事故により停止した場合
• その他、当社が本アプリの提供が困難と判断した場合

Article 5 (Suspension of App Services)

The Company may suspend or interrupt all or part of the App's services without prior notice to Users if it determines that any of the following circumstances exist:

• When performing maintenance, inspection, or updates on the computer system related to the App
• When providing the App becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
• When computers or communication lines are stopped due to accidents
• When the Company otherwise determines that providing the App is difficult

第6条（利用制限および登録抹消）

当社は、ユーザーが本規約のいずれかの条項に違反した場合には、事前の通知なく、 当該ユーザーに対して、本アプリの全部もしくは一部の利用を制限し、 または投稿データを削除することができるものとします。

Article 6 (Usage Restrictions and Deregistration)

If a User violates any provision of these Terms, the Company may, without prior notice, restrict such User's use of all or part of the App, or delete their posted data.

第7条（免責事項）

当社の債務不履行責任は、当社の故意または重過失によらない場合には免責されるものとします。 当社は、何らかの理由によって責任を負う場合にも、 通常生じうる損害の範囲内においてのみ賠償の責任を負うものとします。 また、当社は、本アプリに関連してユーザーと他のユーザーまたは第三者との間において生じた取引、連絡または紛争等について一切責任を負いません。

Article 7 (Disclaimer)

The Company's liability for default shall be exempted unless caused by the Company's willful misconduct or gross negligence. Even when the Company bears liability for any reason, it shall only be liable for compensation within the scope of damages that would normally occur. Furthermore, the Company bears no responsibility for any transactions, communications, or disputes that arise between Users or between Users and third parties in connection with the App.

第8条（サービス内容の変更等）

当社は、ユーザーに通知することなく、本アプリの内容を変更しまたは本アプリの提供を中止することができるものとし、 これによってユーザーに生じた損害について一切の責任を負いません。

Article 8 (Changes to Service Content)

The Company may change the content of the App or discontinue providing the App without notice to Users, and shall bear no responsibility for any damages incurred by Users as a result.

第9条（利用規約の変更）

当社は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。 なお、本規約の変更後、本アプリの利用を開始した場合には、当該ユーザーは変更後の規約に同意したものとみなします。

Article 9 (Changes to Terms of Service)

The Company may change these Terms at any time without notice to Users when deemed necessary. If a User begins using the App after changes to these Terms, such User shall be deemed to have agreed to the revised Terms.

第10条（個人情報の取扱い）

当社は、本アプリの利用によって取得する個人情報については、 当社「プライバシーポリシー」に従い適切に取り扱うものとします。なお、プライバシーポリシーに詳述するとおり、スタンプ生成に用いた元の画像は、当社のサーバーには一切保存されません。

Article 10 (Handling of Personal Information)

The Company shall appropriately handle personal information obtained through the use of the App in accordance with the Company's "Privacy Policy." As detailed in the Privacy Policy, original images used for stamp generation are not stored on the Company's servers.

第11条（準拠法・裁判管轄）

本規約の解釈にあたっては、日本法を準拠法とします。 本アプリに関して紛争が生じた場合には、当社の本店所在地を管轄する裁判所を専属的合意管轄とします。

Article 11 (Governing Law and Jurisdiction)

The interpretation of these Terms shall be governed by Japanese law. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
